Pure Cornwall is a trading name of Cornish Secrets Ltd. The company is registered in England with Registered Number 13296861 and its Registered Address is: Brooklyn, Helscott Road, Marhamchurch, Bude, Cornwall, EX23 0JE.
These Booking Conditions govern the relationship between you (the “Guest”) and Pure Cornwall. Please read them carefully — by making a booking or enquiry you accept them.
1. Pure Cornwall’s Status
1a. For properties booked and managed through Pure Cornwall, Pure Cornwall acts solely as an agent for the Property Owner. The rental arrangements are made by Pure Cornwall on behalf of the Property Owner and the contractual relationship for the holiday is directly between the Property Owner and the Guest.
1b. Pure Cornwall advertises three different kinds of property, and your rights differ depending on which kind you book:
- Managed lettings — bookable end-to-end through Pure Cornwall, where Pure Cornwall acts as booking agent for the Property Owner as described in these Conditions.
- Listings — properties advertised on Pure Cornwall on behalf of their owners, where the enquiry, booking, payment and any resulting holiday contract are made directly between you and the Property Owner. Pure Cornwall simply introduces you to the owner.
- Affiliate properties — properties listed via third‑party partner websites, where the booking, payment and the entire holiday contract are made on, and governed by the terms of, that third‑party website. Pure Cornwall earns a referral commission but is not a party to your booking.
2. Listings and Affiliate Properties — Important Liability Notice
This clause applies to all Listings and Affiliate properties and overrides any conflicting term.
2a. For Listings and Affiliate properties, Pure Cornwall acts only as an introducer and/or directory. Pure Cornwall is not a party to your booking, your payment or your holiday, and no contract for the holiday is formed between you and Pure Cornwall. The contract is solely between you and the Property Owner (for a Listing) or you and the relevant third‑party booking provider (for an Affiliate property).
2b. Pure Cornwall accepts no liability whatsoever for any aspect of a holiday booked as a Listing or via an Affiliate partner, including (without limitation) the booking process, payment, the accuracy or completeness of the property description, availability, pricing, the condition, cleanliness, suitability or safety of the property, check‑in arrangements, cancellation, refunds, deposits, or any loss, damage, injury, expense or inconvenience of any kind arising out of or in connection with the property or the holiday.
2c. Any enquiry, request, dispute, claim or complaint relating to a Listing or Affiliate property must be directed to, and is the sole responsibility of, the Property Owner or the relevant third‑party booking provider. Their terms and conditions, cancellation policy and privacy policy apply to your booking, not these Conditions.
2d. Prices, availability, photographs and descriptions shown on Pure Cornwall for Listings and Affiliate properties are supplied by the Property Owner or third party and may change or differ at the point of booking on the partner website. Where there is any difference, the Property Owner’s or partner’s information and terms prevail.
2e. Nothing in this clause 2 limits any liability that cannot lawfully be limited (see clause 13d).
The remaining Conditions (clauses 3 onwards) apply to Managed lettings booked through Pure Cornwall.
3. Bookings
3a. Booking enquiries can be made by email — info@purecornwall.co.uk — and by telephone (01288 362172).
3b. All bookings made must be accompanied with a deposit.
3c. There is a non‑refundable Booking Fee of £35 per booking.
3d. Your booking is complete and these Conditions are binding once you have received confirmation from Pure Cornwall and a receipt of deposit payment.
4. Deposit
4a. If a booking is made 8 weeks or more before the Holiday is due to start, a deposit of one‑third of the rent is payable.
4b. If a booking is made less than 8 weeks before the Holiday is due to start, the full rent must be paid.
4c. A refundable Damage Deposit of up to £600.00 per property shall be payable at the discretion of Pure Cornwall, which shall be held until the end of occupancy. This will be refunded to the Guest within 2 weeks of departure, subject to deductions for any damage to the property caused during the occupancy. (For bookings greater than 2 weeks the Damage Deposit amount will be doubled.)
5. Final Payment
5a. Unless otherwise agreed by Pure Cornwall in writing, the price for the Holiday shall be the rent for the property as set out on the Pure Cornwall website (www.purecornwall.co.uk) at the time of booking.
5b. As soon as the booking is received and accepted by Pure Cornwall, the Guest is liable for payment of the balance of the rent, along with any additional charges.
5c. Payment of the rent and additional charges are payable to Pure Cornwall 8 weeks before the start of the Holiday (“the Due Date”), and non‑payment by the Due Date may be treated as a cancellation.
5d. If payment is not received by the Due Date, then the Guest will lose their booking and the deposit will be forfeit.
5e. The Due Date will be set out on the Booking Confirmation.
6. Changing a Booking
6a. If you wish to change any of your booking details (e.g. to transfer to a different property or to change the dates) at any time prior to 8 weeks before your arrival date, then there will be a £30 administration fee.
6b. Changing any details within the 8 weeks will be treated as a cancellation.
7. Cancellation by Guests
7a. A booking can only be cancelled prior to the start of the Holiday.
7b. Once your booking has been confirmed, if you wish to cancel you should notify us in writing (“Cancellation Notice”). The day Pure Cornwall receives your Cancellation Notice is the date on which your booking is cancelled.
7c. If you cancel greater than 8 weeks prior to your arrival date then your one‑third deposit will be retained and any balance held by Pure Cornwall shall be returned.
7d. If the written confirmation is received by Pure Cornwall 8 weeks or less from the start date of your holiday, then the full rental payment shall be retained or, alternatively, payable by you.
7e. However, we will immediately place the property back on our letting calendar, and if we are successful in re‑letting it then you will receive a full tariff refund minus your one‑third deposit.
7f. If we are not able to re‑let it, then no monies will be returned.
7g. We strongly recommend that you take out holiday insurance which includes holiday cancellation cover.
8. Cancellation by Pure Cornwall
8a. If the property which you have selected and booked becomes unavailable or unusable for any reason prior to the start date of your holiday, Pure Cornwall will contact you immediately and will use reasonable endeavours to find a suitable alternative with which you are in agreement. If an alternative property is unavailable, you will be reimbursed any sums received from you in respect of the booking contract.
9. Price Changes
9a. Pure Cornwall has made all reasonable efforts to accurately describe the property in the information that we publish.
9b. Pure Cornwall cannot accept responsibility for errors contained in the information or any mis‑description as a result of inaccurate information given to it by the Owner.
9c. You, the Guest, acknowledge that minor differences may arise between the information given and the actual property itself.
9d. Pure Cornwall reserves the right to amend prices quoted in published information due to errors, omissions or changes, but such changes shall be notified to the Guest as soon as possible.
9e. The Guest shall be at liberty to cancel the booking 12 weeks prior to the holiday start date if the amended price is significantly higher than the original price quoted.
10. Method of Payment
Payments may be made by telegraphic bank transfer or by cheque (drawn from a UK bank only). Cheques should be made payable to Pure Cornwall — post‑dated or undated cheques are not acceptable (except in the case of the Damage Deposit payment). All cheque payments must be sent to Pure Cornwall, Brooklyn, Helscott Road, Marhamchurch, Bude, Cornwall, EX23 0JE. Any charges raised against Pure Cornwall by their bank for handling dishonoured cheques, bank transfers or any other payments will be passed on to the Guest, who is liable to reimburse Pure Cornwall within 7 days of receipt of notification from Pure Cornwall.
11. Letting Commences
Letting commences at 4.00 pm on the first day of tenancy and ends at 10.00 am on the day of departure, unless notified otherwise.
12. Liability
12a. Pure Cornwall will not be liable for any act, neglect or default on the part of the Owners or any other person not within their employment or otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience — whether to person or property — which the Guest or any other person may have suffered or incurred out of, or in any way connected with, the rental, unless Pure Cornwall is responsible. In addition, the Owners and Pure Cornwall accept no liability for loss of or damage to the Guest’s possessions on the Owner’s property or land.
12b. Pure Cornwall and the Owner shall have no liability for any non‑performance of their obligations if such failure results from events, circumstances or causes beyond their reasonable control, such as a breakdown of domestic appliances, internet access, mobile phone reception, plumbing or wiring, and unforeseen exceptional weather conditions.
12c. Pure Cornwall accepts no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
12d. Nothing in these Conditions excludes or limits the liability of Pure Cornwall or the Owner:
- for death or personal injury caused by Pure Cornwall’s or the Owners’ negligence; or
- under section 2(3), Consumer Protection Act 1987; or
- for any matter which it would be illegal for Pure Cornwall or the Owner to exclude, or attempt to exclude, their liability; or
- for fraud or fraudulent misrepresentation.
12e. In all cases, except for personal injury or death, our liability to you for the total of all claims arising out of the letting is limited to the cost of the booking fees, less any insurance or cancellation charges.
13. The Guest’s Obligations
The Guest agrees:
- to pay for any losses or damages to the property caused by you or a member of your party;
- to take good care of the property and leave it in a clean and tidy condition at the end of the letting. A cleaning service is not provided during the letting unless otherwise specified or agreed in writing with Pure Cornwall;
- to permit the Owner reasonable access to the property;
- not to part with possession of the property, or share it, except with members of the party confirmed in the booking;
- not to sell or transfer the booking to another without the written consent of Pure Cornwall;
- not to use a cot for a child over the age of 12 months; and
- not to have anyone other than those detailed at the time of the booking and listed in the Booking Confirmation staying at the property;
- to respect the well‑being of neighbours and not to cause any annoyance or become a nuisance. Complaints from adjoining or nearby occupants to Pure Cornwall regarding your behaviour may result in the Owner requiring you to leave the property immediately, without a refund of any monies paid by you.
14. Breach of Contract
14a. If there shall be a material breach of any of these Conditions by you, the Owner or Pure Cornwall reserve the right to re‑enter the property and terminate the letting.
14b. If there shall be a material breach of any of these Conditions by Pure Cornwall or the Owner, then you have the right to terminate the letting.
14c. In the event that Pure Cornwall is unable to find someone else to occupy the property for the remainder of your stay, no refund of any sums you have paid will be returnable to you.
14d. Termination of the letting pursuant to conditions 14a and 14b does not affect that party’s other rights and remedies.
15. Complaints
Any complaints must be notified to the agent immediately, so that immediate action can take place if necessary. In no circumstances will compensation be made for complaints made after the tenancy has ended.
16. Validity Condition
If any term or provision in these Booking Conditions is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable, it shall — to the extent of such illegality, invalidity, voidness or unreasonableness — be deemed severable, and the remaining provisions of the Booking Conditions and the remainder of such provision shall continue in full force and effect.
17. Governing Law
The contract embodied in the booking is governed by English law and is subject to the exclusive jurisdiction of the English courts.
18. Pet‑Specific Terms & Conditions
18a. Please note that, whilst we have a number of properties where the owners are happy for you to bring pets, there are no specific property modifications that have taken place to accommodate pets.
18b. Dogs are only permitted at those properties that are marketed as such, and the number of dogs that each property accommodates is detailed on each property listing. If you wish to holiday with a pet other than a dog, it would be necessary for Pure Cornwall to achieve consent from the owner prior to confirming your booking.
18c. An additional accommodation charge is applicable for bookings that include dogs. This additional charge will be clearly detailed against your booking, and the fee is payable prior to your arrival at the property.
18d. Please do not leave your pets alone or unsupervised in the property at any time during your stay.
18e. Pets are not permitted in the bedrooms or on the furniture at any time.
18f. For the safety and comfort of your dog, we request that owners exercise due diligence at all times, especially where the property is located near a road or livestock. Neither Pure Cornwall nor the property owner can accept responsibility for the safety of your pet.
18g. We request that you bring your own pet provisions, including bedding.
18h. Pets should be cleaned and fully dried off before entering the property after being outside.
18i. In the interests of hygiene, health and safety, and out of consideration for others, it is important that you clean up after your pet and dispose of any mess in a sanitary and responsible manner.
18j. You are responsible for any damage caused by your pet, whether inside or outside the property. If extra cleaning is required as a result of a guest having pets in the property, this may be deducted from your Damage Deposit.
19. Wi‑Fi
19a. Whilst free Wi‑Fi is available at most of our properties, Pure Cornwall does not accept liability for any breakdown in service or restrictions of broadband width and transmission speeds. However, we will endeavour to resolve any problems as soon as possible.
20. Previous Terms & Conditions
These Terms & Conditions replace and supersede all previous Terms & Conditions.
